Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of Menusaic, a digital menu and QR code platform, including our website (menusaic.com), our dashboard (admin.menusaic.com), and the public menus we host (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who operates Menusaic
Menusaic is an online-only service (the "Operator," "we," "us," or "our"). It has no registered physical company, office, or legal entity behind it today, and is run as a free, early-stage, pre-revenue hobby project by whoever maintains it. If and when Menusaic takes on paying customers, it will be operated through a registered business entity, and these Terms will be updated to name that entity and re-issued to active users.
2. Who can use Menusaic
Menusaic is intended for businesses, specifically restaurants, cafes, and similar food and beverage venues, and the individuals authorized to manage their account. By registering, you confirm that you are at least 18 years old, are signing up on behalf of a genuine business (or as a sole trader operating one), and have the authority to agree to these Terms on that business's behalf.
3. This is a hobby project: use it at your own risk
We want to be completely upfront about what Menusaic is today. This is a free, hobby- grade SaaS project, run by one person, with no company, no funding, no support team, and no commercial infrastructure behind it. It is not a mature, professionally-run platform, and you should treat it accordingly. You use the Service entirely at your own risk.
Concretely, this means:
- Menusaic currently runs on infrastructure the Operator personally owns and manages at a private location, not on a commercial cloud platform.
- The Service may become slow, unavailable, or go offline at any time, for any length of time, including due to power outages, internet outages, hardware failure, maintenance, a security incident, or any other cause, with or without notice.
- We do not offer any uptime guarantee or service-level agreement (SLA) for the free plan.
- We may discontinue the Service entirely, temporarily or permanently, at the Operator's discretion, with notice where reasonably practical given the circumstances.
- Despite our reasonable efforts to keep data secure (see our Privacy Policy), a data breach, data loss, or security incident is possible, as it is with any online service, and more realistically so for a single-person, self-hosted project than for a large funded platform.
- You should not treat Menusaic as your only system for storing or displaying your menu. Keep your own copy of your menu content (text, prices, photos) elsewhere, so you can continue operating if the Service is unavailable, degraded, or discontinued.
By using the Service, you accept this risk and agree that the Operator is not responsible for losses arising from it, as set out fully in Sections 9 and 10 below. If a higher level of guaranteed availability or support becomes important to your business, that may be something we offer as part of a future paid plan, with its own separate terms, once one exists.
4. The free plan, future paid plans, and changes to features
Menusaic is currently free, with no paid plans available. We may introduce paid subscription plans in the future, and features that are free today may move to a paid plan later. If we move a feature you're actively using to a paid plan, we will try to give you reasonable advance notice by email or through the dashboard before the change takes effect, so you can decide whether to upgrade or adjust how you use the Service. Because we are a single-person, pre-revenue project rather than a company with a formal change-management process, "reasonable notice" may be shorter than you'd expect from a larger company, and in some cases may not be possible at all (for example, if we need to shut a feature down quickly for cost or legal reasons).
More broadly, we may add, modify, limit, or discontinue any part of the Service at any time, including features, templates, limits, and pricing, to reflect how the product evolves. The Service is provided on an evolving, early-stage basis, not as a fixed, unchanging product.
5. Subscriptions and billing (once paid plans exist)
No part of Menusaic currently requires payment, and we do not collect or process payment information today. If and when we introduce paid plans, the following will apply, and this section will be updated with specifics (such as the payment processor used) before any charges begin:
- Paid plans will renew automatically at the end of each billing period until cancelled, unless stated otherwise at sign-up.
- You'll be able to cancel at any time from the dashboard; cancellation will take effect at the end of the current billing period, and we won't provide partial refunds for unused time except where required by law.
- We'll give reasonable advance notice, by email, before any price increase takes effect on your next renewal.
- Payments will be processed by a third-party payment processor; we will not store your full card details ourselves.
- Because Menusaic is a business-to-business service, the EU/UK consumer right of withdrawal generally will not apply once you've started using a paid plan; if you're signing up as an individual consumer rather than a business, contact us before subscribing so we can confirm which rights apply to you.
6. Your content
You own the content you upload to Menusaic, including your menu text, prices, photos, and branding ("Your Content"). By uploading it, you grant us a limited license to host, store, display, and process Your Content solely to provide the Service, including showing your public menu to your customers. You're responsible for making sure Your Content is accurate and that you have the rights to use it (for example, that you own or are licensed to use any photos you upload).
7. Acceptable use
You agree not to use Menusaic to:
- Upload content that is illegal, fraudulent, defamatory, or infringes someone else's intellectual property or privacy rights.
- Misrepresent your business, prices, or the food/beverage items you're actually offering.
- Attempt to break, bypass, or reverse-engineer the Service, or access it through means other than the interfaces we provide.
- Use the Service to send spam, malware, or to scrape or resell our platform without permission.
- Interfere with the Service's security or availability for other users, including by placing unreasonable load on infrastructure that, as described above, is not enterprise-scale.
We may suspend or terminate accounts that violate this section, with notice where practical.
8. Intellectual property
Menusaic, our logo, the khatam star mark, our platform design, and underlying software belong to the Operator (or, once incorporated, the operating company) and are protected by intellectual property law. These Terms don't grant you any rights to our brand or software beyond what's needed to use the Service as intended.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, error-free, or free of data breaches. Given everything described in Section 3, this disclaimer is not boilerplate, it reflects how the Service actually runs today: a free hobby project, not a professionally-run commercial platform.
10. Limitation of liability
To the maximum extent permitted by law: if you are using the free plan and have not paid us anything, the Operator's total liability to you for any claim arising from these Terms or the Service is zero. This includes, without limitation, claims relating to downtime or unavailability, data loss or corruption, a security incident or data breach, lost business, lost revenue, or any other damages, however caused, even if the Operator was negligent or had been advised the damage was possible.
If you are on a future paid plan, the Operator's (or operating company's) total liability to you for any such claim is limited to the amount you actually paid in the 12 months before the claim arose. In no case is the Operator liable for indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or lost data, even if advised they were possible.
This limitation applies to the fullest extent the law allows. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for death, personal injury, or fraud, but outside of those narrow, legally-mandatory exceptions, you agree that running or relying on a free hobby project carries real risk that you, not the Operator, are accepting by using the Service.
11. Termination
You can stop using Menusaic and delete your account at any time from the dashboard. We may suspend or terminate your account if you materially breach these Terms, or if we reasonably believe your use poses a risk to the Service or other users, with notice where practical given the circumstances. We may also discontinue the Service as described in Section 3.
12. Changes to these Terms
We may update these Terms as the Service evolves, including as we incorporate a company, move to professional hosting, or introduce paid plans. If we make a material change, we'll update the "last updated" date above and, where reasonably practical, notify you directly. Continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law and disputes
Menusaic is offered online to businesses in every country, but it is run by a single individual rather than a registered company (see section 1). These Terms are therefore governed by the laws of the country in which the operator of Menusaic is habitually resident, without regard to conflict-of-law rules, and any dispute arising from these Terms or the Service will be subject to the jurisdiction of the competent courts of that country.
This does not take away any rights you have under mandatory law in your own country, including consumer-protection law that lets you bring a claim where you live.
Before starting any formal proceedings, please contact us at support@menusaic.com so we can try to resolve the issue informally. Most problems with a free service can be sorted out by email.
Once Menusaic is operated through a registered business entity, this section will be updated to name the specific governing law and courts.
